Incoterms and Risk Allocation
All international orders are governed by Incoterms 2020 as agreed and specified in the Proforma Invoice. The applicable Incoterms determine where the risk of loss or damage transfers from the Company to the Buyer and which party bears specific costs and responsibilities.
Common Incoterms we offer include:
- EXW (Ex Works): The Buyer bears all costs and risks from our factory or warehouse. The Buyer arranges and pays for all transportation, export clearance, and freight.
- FOB (Free On Board): Risk transfers to the Buyer once goods are loaded on board the vessel at the Indian port of shipment. The Company handles Indian export clearance and inland freight to the port.
- CIF (Cost, Insurance, and Freight): The Company is responsible for cost, insurance, and freight to the named port of destination. Risk transfers to the Buyer once goods are loaded on board the vessel.
- DAP (Delivered at Place): The Company is responsible for delivery to the named place at destination, but import clearance and duties are the Buyer’s responsibility.
If no specific Incoterms are agreed upon, FOB shall be the default for sea freight shipments. Any deviation from the agreed Incoterms must be confirmed in writing.
Packaging
We package all Products using appropriate protective materials to minimise risk of damage during handling and transit. Standard packaging includes:
- Individual product wrapping with bubble wrap, foam, or tissue
- Master carton packing with adequate internal cushioning
- Wooden crating or pallet packing for large, fragile, or high-value consignments (available at additional cost)
- Export-grade corrugated cartons compliant with standard shipping requirements
Packaging specifications may be customised upon request for large or recurring wholesale orders. Special branding, private labelling, or custom packaging inserts are available subject to additional charges and minimum quantities.
Export Documentation
For all international shipments, the Company prepares and provides standard export documentation, which may include:
- Commercial Invoice
- Packing List
- Bill of Lading or Airway Bill
- Certificate of Origin (issued by the relevant chamber of commerce or authority as applicable)
- Export Declaration / Shipping Bill (as required under Indian customs law)
- Phytosanitary Certificate (where required for wooden products entering certain countries)
- Any other documentation specifically requested by the Buyer or required by the importing country
Phytosanitary Requirements for Wooden Products
Many countries, including EU member states, the United Kingdom, the United States, and Australia, impose phytosanitary or ISPM-15 (International Standards for Phytosanitary Measures No. 15) requirements for wooden packaging materials and wooden products used as packaging. Where applicable, our wood packaging complies with ISPM-15 heat treatment or fumigation standards, and relevant certificates will be provided.
It is the Buyer’s responsibility to notify us in advance of any specific certification requirements applicable in their country. Additional certification costs may apply.
Shipping Methods and Carriers
We ship via reputable international carriers and freight forwarding services, including both sea freight (FCL/LCL) and air freight, depending on the order volume, weight, and urgency.
- Sea Freight (Full Container Load – FCL): Suitable for large wholesale orders. Standard transit times range from fifteen (15) to forty-five (45) days depending on the destination port.
- Sea Freight (Less than Container Load – LCL): Suitable for mid-size orders consolidated with other shipments.
- Air Freight: Suitable for smaller, time-sensitive, or high-value orders. Transit times typically range from three (3) to ten (10) business days.
- Courier Services: For samples and small orders, we may use international courier services such as DHL, FedEx, or UPS.
The Company will recommend the most appropriate and cost-effective shipping method based on your order. All freight charges are borne by the Buyer unless CIF or similar terms are expressly agreed.
Lead Times and Shipping Schedule
All quoted lead times are estimates and commence from the date of receipt of the agreed advance payment and final confirmation of product specifications. Actual lead times depend on product type, customisation requirements, and order volume.
Indicative lead times are as follows:
- Standard in-stock items: Seven (7) to fifteen (15) business days for production and packing
- Custom and wholesale orders: Twenty-one (21) to sixty (60) business days, depending on complexity and volume
- Sample orders: Seven (7) to fourteen (14) business days
The Company shall not be held liable for delays caused by circumstances beyond its reasonable control. See the Force Majeure section below.
Freight Costs and Insurance
Unless otherwise agreed:
- All freight, shipping, and handling charges are borne by the Buyer and will be quoted separately or included in the Proforma Invoice based on agreed Incoterms.
- Marine or cargo insurance for international shipments is the Buyer’s responsibility under FOB and EXW terms. The Company will arrange insurance on the Buyer’s behalf and at the Buyer’s cost if CIF terms are agreed.
- We strongly recommend that all Buyers arrange appropriate cargo insurance for international shipments to protect against loss or damage in transit.
Import Duties, Taxes, and Customs Clearance
Buyers are solely responsible for:
- All import duties, taxes, levies, VAT, customs fees, port handling charges, and any other charges imposed by the destination country’s customs authorities
- Compliance with all import regulations, licensing requirements, and restrictions applicable in the destination country
- Obtaining any required import permits, certificates, or approvals
The Company will provide accurate and complete export documentation to facilitate customs clearance. However, the Company accepts no liability for delays, detentions, seizures, or additional costs arising from customs procedures in the destination country.
For EU Buyers: Import VAT and customs duties will apply upon entry into the European Union. The applicable duty rate depends on the HS (Harmonised System) tariff code of the specific product. Buyers are encouraged to consult their customs broker or freight forwarder to understand applicable rates.
For UK Buyers: Post-Brexit customs rules apply to all imports from India into the United Kingdom. UK import duty and VAT will apply as determined by UK customs tariff schedules.
For US Buyers: US import duties (Section 321 de minimis thresholds and standard tariff rates) may apply depending on the declared customs value of the shipment.
Restricted, Prohibited, and Regulated Items
Certain products may be subject to import restrictions in specific countries. Buyers are responsible for confirming that the products they order are permitted for import into their country and comply with all applicable regulations, including:
- CITES (Convention on International Trade in Endangered Species) — relevant to certain types of wood or materials
- Weapons and replica regulations — relevant to medieval-inspired metal products such as helmets and armor
- Consumer product safety regulations (e.g., CE marking requirements in the EU, CPSC standards in the USA)
- Material composition and labelling requirements
The Company does not warrant that its Products are automatically compliant with the import regulations of every country. Buyers must conduct their own due diligence and obtain appropriate approvals where required. The Company will provide material information about product composition upon request.
Tracking and Delivery Confirmation
Once goods are dispatched, the Company will provide the Buyer with the Bill of Lading number, Airway Bill number, or courier tracking number, as applicable. Buyers are responsible for monitoring shipment progress and coordinating receipt at the destination.
Damage or Loss in Transit
Risk of damage or loss transfers to the Buyer as per the agreed Incoterms. In the event of visible damage upon delivery:
- The Buyer must note the damage on the carrier’s delivery documentation before signing
- The Buyer must preserve all packaging materials for inspection
- Written notice with supporting photographs must be submitted to the Company within five (5) business days of receipt
- Claims must be filed directly with the carrier or insurance provider as applicable
Concealed damage discovered after unpacking must be reported to us within seven (7) business days of receipt. Claims submitted outside these timeframes may not be eligible for resolution.
Force Majeure
The Company shall not be liable for any delay or failure to perform its shipping or delivery obligations arising from causes beyond its reasonable control, including but not limited to: natural disasters, extreme weather conditions, acts of war, pandemics, government-imposed trade restrictions, port closures, customs delays, carrier disruptions, or labour disputes. In such events, the Company will notify the Buyer as soon as reasonably practicable and will use reasonable endeavours to mitigate the impact of the delay.
